1.1 Acceptance of Terms: By accessing and using the website https://icrfoundations.org/ (“the Website”), managed by the non-profit organization SYNERGIA PLUS based in Slovakia, you agree to abide by these Terms and Conditions. If you do not agree to these terms, please refrain from using the Website.

1.2 Objective: The Website is dedicated to the cause of supporting children in Gaza. It serves as a platform to provide information, gather support, and create awareness about the efforts of SYNERGIA PLUS in this regard.

1.3 Modifications: SYNERGIA PLUS reserves the right to modify these Terms and Conditions at any time without prior notice. Users are encouraged to regularly check for any updates.

1.4 Copyright: All content on the Website, including but not limited to text, graphics, logos, and images, is the property of SYNERGIA PLUS or its content providers and is protected by copyright laws.

THIS SITE IS OPERATED IN SLOVAKIA. IF YOU ARE LOCATED OUTSIDE SLOVAKIA, PLEASE BE AWARE THAT ANY DATA YOU PROVIDE TO US WILL BE TRANSFERRED TO SLOVAKIA. THIS LOCATION MAY PROVIDE A LOWER LEVEL OF PROTECTIONS AS THOSE IN YOUR OWN COUNTRY. BY USING THE SITE, YOU CONSENT TO THIS TRANSFER, RETENTION, AND PROCESSING OF YOUR INFORMATION IN SLOVAKIA AND WITH OUR PARTNERS AND THIRD PARTIES OUTSIDE SLOVAKIA.

Indemnification

Governing Law and Jurisdiction

1. Governing Law: This Agreement, and any dispute, controversy, proceedings, or claim of whatever nature arising out of or in any way relating to this Agreement or its formation, shall be governed by and construed in accordance with the laws of the Slovak Republic.
2. Jurisdiction: The parties irrevocably submit to the exclusive jurisdiction of the courts of the Slovak Republic to settle any dispute or claim that arises out of or in connection with this Agreement or its subject matter or formation.

Arbitration

At Company’s sole discretion, it may require You to submit any disputes arising from these Terms of Use or use of the Website, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying Illinois law.

Limitation on Time to File Claims

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

Waiver and Severability

No waiver by the Company of any term or condition set out in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect. 

Entire Agreement

The Terms of Use and our Privacy Policy constitute the sole and entire agreement between you and ICRF regarding the Website and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Website.
